Introduction
This Privacy Policy is intended to inform professional clients, authorised users, and any visitor (hereinafter "the User") of the terms under which 2MA TECH SOLUTIONS, a company established in France and publisher of the Clear Discount software, collects, processes, and protects their personal data, in accordance with Regulation (EU) 2016/679 of 27 April 2016 known as the "GDPR", Act No. 78-17 of 6 January 1978 as amended relating to data processing, files, and civil liberties, as well as the recommendations of the CNIL.
1. Data Controller
In the context of operating its software accessible in a free version and by subscription via the Shopify platform, the Publisher 2MA TECH SOLUTIONS, RCS 930 283 114, represented by Matthieu Mariey, in his capacity as Manager, collects and processes personal data necessary for the creation and management of User accounts, subscription tracking, the performance of licensed services, and technical assistance and support. Certain data may also be processed for legal or security obligations, or for continuous service improvement purposes.

2. Data Collected & Purposes
The Client consents to the collection and processing of their personal data by 2MA TECH SOLUTIONS for the purposes of performing this contract. The personal data collected may include, without limitation, name, address, email address, phone number, and other information necessary for the performance of the contract.
In order to adapt the service to the Client's country of residence (particularly with regard to service configuration), geolocation data may be processed. This geolocation is strictly limited to identifying the Client's country or geographical area and does not in any way constitute real-time tracking.
Geolocation data, including GPS coordinates where available, is collected by the Shopify platform, acting as a processor, and then transmitted to the Service Provider strictly within the framework of service performance.
The Client's personal data will be used exclusively for the purposes of subscription management, service delivery, invoicing, communication with the Client regarding the Services, as well as for accounting and tax purposes. It may also be retained for security purposes, in order to comply with legal and regulatory obligations.
Access to personal data will be strictly limited to employees of the data controller who are authorised to process it by virtue of their roles. The information collected may be communicated to third parties linked to the company by contract for the performance of outsourced tasks, without the Client's authorisation being required.
3. Recipients
Data may be transmitted to the following categories of recipients: Shopify (sales platform / payments – processor), software host "AWS", analytics provider, accounting provider, support or CRM provider. All processors comply with the requirements of the GDPR (Art. 28).
4. Transfers Outside the EU
Due to the organisation of the company responsible for the Platform within an international group, the user authorises the Platform to transfer, store, and process their information in the United States. The laws in force in that country may differ from the laws applicable in the user's place of residence within the European Union. By using the Platform, the user consents to the transfer of their personal data to the United States. In that case, the Platform remains responsible for the personal data shared with third parties, in accordance with the European Commission's adequacy decision of 10 July 2023 finding that the United States ensures a level of protection equivalent to that of the EU.
5. Retention Period
Under legal and regulatory obligations, we are required to retain your client data for tax and accounting purposes for a period of 10 years.
Regarding logs and backups, 2MA TECH SOLUTIONS complies with the durations, security requirements, and CNIL rules.
6. Security
In accordance with Article 8.3 of the GTS, passwords are not managed by the Service Provider but by a third party, namely Shopify. Please refer to Article 8.3 of the GTS for details.
7. Rights of Individuals
Under the applicable personal data regulations, users have the following rights: right of access (to know the personal data held about them), right of rectification (to update data by logging into their account), right of erasure (to delete their account and the data relating to them), right to restriction, right to object, and right to data portability.

8. Cookies & Trackers
An information banner allows the user to accept or refuse non-essential cookies. Essential technical cookies do not require consent.
Cookies are used in the context of using the site. The user has the option to disable cookies from their browser settings.
The site may automatically collect standard information. All information collected indirectly will only be used to track the volume, type, and configuration of traffic using the site, to develop its design and layout, and for other administrative and planning purposes, and more generally to improve the service we offer you.
